SERVICE AGREEMENT

Terms of Service

These pilot terms apply to a paid FilterEvidence Australia qualification pre-screen unless an accepted written scope states otherwise.

Agreement and order of documents

Each order must be recorded in writing. A contract is formed only when we issue a written scope confirmation or quote identifying the legal customer, service, deliverable, fee, currency, payment route and delivery trigger, and the customer accepts it in writing or pays the stated fee. The accepted scope controls the specific deliverable; these Terms control general service conditions. The Privacy Policy, Refund & Cancellation Rules and Data Retention & Deletion Notice are incorporated by reference where linked in the accepted order. Mandatory legal rights continue to apply.

Service included

  • A structured requirement frame based on customer-supplied information.
  • A larger, requirement-relevant China search universe and recorded narrowing funnel.
  • A final evidence-qualified shortlist, normally 3–5 candidates, with evidence cards, comparison, gaps, risks and questions.
  • A traceable English PDF or agreed secure web report.
  • One consolidated written clarification within the period stated in the scope confirmation.

Not included

  • Engineering design or approval, site inspection, laboratory or sample testing.
  • Procurement execution, price negotiation, supplier appointment or continuing supplier management.
  • Guarantees of selection, performance, quality, lifetime, availability, lead time or supplier conduct.
  • Sample handling, inspection, logistics, customs, tax or import agency.
  • Receipt or handling of procurement funds.
Engineering control

The customer and/or end user remains responsible for final specifications, engineering approval, supplier due diligence, sample testing and purchasing decisions.

Evidence standard and limitations

We distinguish source-supported facts, evidence-based inference and matters still requiring confirmation. Public and third-party sources may be incomplete, outdated or inaccurate. A company statement is reported as a company statement unless independently supported. The Brief is a qualification pre-screen—not a certification, audit, warranty or engineering conclusion.

Customer responsibilities

  • Provide accurate, complete and authorised information and identify restricted material.
  • Do not submit export-controlled technology, government-classified information, personal identity documents, payment-card details or unnecessary sensitive information.
  • Review the requirement frame and resolve material gaps or conflicts promptly.
  • Ensure submitted information may lawfully be disclosed to and processed by us and our stated service providers.
  • Make final technical, safety, regulatory, commercial and procurement decisions using qualified personnel.

Fees, payment, taxes and records

The accepted quote states the fee, currency, payment method, bank or processor charges and applicable tax treatment. A payment screenshot or transfer instruction does not prove settlement. For the pilot, paid work normally begins only after cleared funds are visible and an authorised human records “Payment Accepted”. We do not request procurement funds or supplier payments.

Customer-facing commercial invoices and receipts are distinct from any statutory PRC tax or accounting document. We do not describe a document as an Australian “Tax Invoice” or charge Australian GST unless the applicable treatment has been confirmed. The customer must provide the legal name and address needed for the written service contract and commercial records.

Information Complete and delivery clock

The two-Business-Day clock begins only when both Payment Accepted and Information Complete are confirmed in writing. A Business Day is Monday–Friday in Australia/Sydney, excluding NSW public holidays. Delivery is due by 5:00 pm on the second following Business Day after the written clock-start notice. A valid pause or customer-requested scope change will be recorded and explained.

Scope changes, delivery and clarification

A material change to application, equipment, process, evidence standard, number of markets or deliverable requires written agreement on any fee, information and timing effect. Delivery uses the secure method stated in the scope. One written clarification means one consolidated request about the delivered Brief; it does not include new research, changed requirements, supplier engagement or engineering advice.

Intellectual property, confidentiality and data handling

The customer retains its original information. After full payment, it receives a non-exclusive licence to use the Brief for the stated business purpose and share it with relevant personnel, its end user and professional advisers under appropriate confidentiality. FilterEvidence retains its methods, templates, evidence structure, general know-how and pre-existing materials. Each party must reasonably protect non-public engagement information. Our handling of personal information and customer workbooks is also governed by the Privacy Policy and Data Retention & Deletion Notice.

Consumer guarantees, remedies and third parties

Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees. We are responsible for performing the agreed research service with due care and skill. We are not responsible for a supplier’s later statements or performance, or the customer’s engineering, procurement or investment decision, except where liability cannot lawfully be excluded or results from our breach or negligence.

Refunds, complaints and disputes

Our Refund & Cancellation Rules operate in addition to non-excludable rights. Send complaints to liufg8@gmail.com with the case number and requested outcome. We aim to acknowledge them within two Business Days and provide a substantive response within ten Business Days. The parties should first attempt good-faith written resolution. No unilateral governing-law or forum clause is imposed by this pilot page; any such clause must appear in an accepted contract after appropriate advice.

Changes

The version accepted for an order remains applicable to that order unless both parties agree otherwise. Updated website Terms apply only to later orders and show their effective date.
